My colleague, Katherine Sinclair (legal director) and I discuss the recent Employment Appeal Tribunal case of Garrod v Riverstone Management Ltd. The case offered some useful guidance on 'without prejudice' discussions; something rarely debated in the tribunals and yet used so regularly in practice. We discuss questions such as:
- What elements of a discussion make it without prejudice?
- When does without prejudice fall away?
- How does that fit with protected conversations?
- What are the practical considerations?
- How do you best prepare for these scenarios?
