What is the Office of the Public Guardian and why does it matter?

If you’ve ever found yourself navigating the world of Powers of Attorney or deputyship, you’ve probably heard ‘OPG’ along the way. Although, you may have found yourself wondering: what is the OPG and what does it actually do? 

The Office of the Public Guardian (OPG) is the government body responsible for supporting individuals who may not have the mental capacity to make decisions regarding their property and financial affairs. 

The OPG has a crucial role in ensuring that attorneys and deputies act lawfully and in the best interests of the people they support. 

The OPG’s key responsibilities include:

  • Dealing with the registration of Lasting Powers of Attorney
  • Supervising attorneys and deputies
  • Investigating concerns about an attorney or deputy’s decision-making
  • Reviewing and processing annual deputy reports. 

In essence, the OPG’s role centres on the day-to-day oversight of attorneys and deputies. It helps ensure that they understand their responsibilities and are acting appropriately and transparently in the individual’s best interests. For example, while the court makes decisions about authority, the OPG focuses on supervising how attorneys and deputies exercise that authority. Overall, the OPG exists to provide structure and transparency in the operation of attorneyships and deputyships.
