Why probate matters and how to prepare for it

Starting the year is a great time to get organised and make sure your affairs are in order. 

One important part of this is understanding probate if you are responsible for dealing with the administration of an estate for a loved one or a friend.  

Probate is the legal process that makes sure a person’s money, property and possessions are dealt with properly after they die. If there is a Will, the Probate Registry checks it and issues the Grant of Probate to the Executor, which gives them permission to collect assets, pay any debts and share everything according to the person’s wishes in the Will.  

If there is no Will, an Administrator is appointed to do the same job, but the estate is divided according to the law (called intestacy) rather than personal wishes.
