When it comes to planning for the future, many people focus on Wills but often forget about something just as important: Lasting Powers of Attorney (LPAs). These legal documents ensure that someone you trust can make decisions on your behalf if you lose capacity in the future.
And with a fee increase coming in November 2025, now is the perfect time to act.
What is an LPA?
An LPA allows you to appoint one or more people (your attorneys) to make decisions for you if you lose mental capacity. There are two types:
- Property and Financial Affairs LPA - This covers decisions about money, property and finances, like paying bills, managing bank accounts or selling your home. This type can be used at your direction whilst you have mental capacity and if you lose mental capacity.
- Health and Welfare LPA - This covers decisions about your care, medical treatment and living arrangements. This type can only be used if you’ve lost mental capacity.
You can choose to make one or both types, depending on your needs.
Fee increase from November 2025
LPAs need to be registered to be used and the Ministry of Justice has announced that, subject to parliamentary approval, the fee to register each LPA will increase from £82 to £92 from 17 November 2025. That means up to an extra £40 per couple.
Fee exemptions and remissions
If you're on a low income or receive certain benefits, you may be eligible for a fee exemption or reduction.
Why LPAs matter
Without an LPA, your loved ones may need to apply to the Court of Protection for a Deputyship Order to be able to make decisions for you. This is a process that’s time-consuming, expensive and emotionally draining. It also takes away your choice of who is responsible for managing your affairs if you are not able to do so yourself.
An LPA gives you control now, so your wishes are respected later.
Common misconceptions
“I’m too young for an LPA.”
LPAs aren’t just for older people. Accidents and illnesses can happen at any age.
“I’ll do it later.”
LPAs can only be made while you have mental capacity. Waiting too long could mean it’s too late.
