Will we start to see an increase in possession claim based on riot offences?

It's heartbreaking to watch the growing unrest across the county this weekend. 

The police have an unenviable task of seeking to maintain order. No doubt they will also be kept incredibly busy in the aftermath as they investigate and take action on crimes committed during these violent gatherings. 

Social Housing providers should remember that if any of their tenants or their household members (over 18) are ‘convicted of an indictable offence which took place during, and at the scene of, a riot’ this could give rise to a discretionary ground for possession. 

This is found at Ground 2ZA for secure tenancies and 14ZA for assured tenancies. Depending on the individual circumstances, enforcement action could be an option to consider.
