Beware bank holidays - new Notice of Seeking Possession template lands....

Yet again, a new template Notice of Seeking Possession (NSP) for assured tenants has been issued on a bank holiday with no prior warning. The changes are to take into account the new Breathing Space debt scheme which came into force on 4 May 2021 as well.   

Landlords will need to amend their template NSPs and re-serve NSPs served at the end of last week. The secure tenancy template NSP has not been updated - for reasons unknown!  

The snappily named Assured Tenancies and Agricultural Occupancies (Forms) (moratorium Debt) (Consequential Amendment) (England) Regulations came into force on Monday 3 May 2021. The big news is that the Notice Seeking Possession (NSP) prescribed form has been amended to incorporate references to the Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England and Wales) Regulations 2020 which also came into force on Monday. This is a prescribed form so must be used. Please see our recent ebriefing for more information on “Breathing Space”.
